Superior Court of the District of Columbia, Probate Division (Guardianship and Conservatorship)
The Probate Division of DC Superior Court hears petitions to appoint a guardian for personal decisions or a conservator for financial matters for adults who cannot make those decisions because of disability, illness or injury. A petition requires medical evidence, a criminal history statement and a $45 filing fee which can be waived, and a hearing is usually set about a month after filing. Appointed guardians and conservators must pass background checks, file a care plan within 90 days and report to the court regularly. The court is required to consider less restrictive alternatives first, including powers of attorney, advance directives, representative payee arrangements, supported decision-making and informal family support. A Probate Self-Help Center is open to the public on weekdays.
